In this Privacy Policy, “we”, “our” and “us” refers to LXT REAL ESTATE BROKERS LLC and its affiliates (collectively, “LUXHABITAT”); “the website” refers to the LUXHABITAT websites (including www.luxhabitat.ae); the website and our mobile applications together are the “platforms”; and “you” and “your” refers to a specific individual accessing and using the platforms or the services that we provide.

LUXHABITAT respects your privacy and is committed to protecting it. We provide this Privacy Policy to inform you of our privacy procedures and practices, as well as to describe what information we collect about you, how we obtain your information, and how we use, share and otherwise process your information in the course of operating our business and our platforms. We may update or revise this Privacy Policy at any time and this page will always reflect the current version.

1. Scope

This Privacy Policy describes how we collect, use and/or otherwise process your personal data for our services on the website of LUXHABITAT (the “Site” ). Subject to the requirements of applicable law, we strive to provide a consistent set of privacy practices throughout the global LUXHABITAT community. We ascertain that our processing of your personal data is and remains lawful and base such processing on your consent to the processing of your personal data for the specific purposes as described herein. When necessary, your consent must be given by a clear affirmative act at registration. This Privacy Policy is effective upon such act.

2. Collection

You can browse our Site without telling us who you are or revealing any personal data about yourself. Once you give us your personal data, you are not anonymous to us.

• e-mail address, physical address and (depending on the service used); 

• transactional information based on your activities on the Site (such as buying, selling, item and content you generate or that relates to your account); 

• billing and other information you provide to purchase an item; 

• chats, dispute resolution, correspondence through our Site, and correspondence sent to us; 

• other information from your interaction with our Site, services, content and advertising, including computer and connection information, statistics on page views, traffic to and from the Site, ad data, cookies, IP address and standard web log information; 

• information from other companies, such as demographic and traffic data; 

• other supplemental information from third parties (for example, if you incur a debt to LUXHABITAT, we will generally conduct a credit check by obtaining additional information about you from a credit bureau, as permitted by law; or if the information you provide cannot be verified, we may ask you to send us additional information, such as your driver license, credit card statement, or a recent utility bill or other information confirming your address, or to answer additional questions online to help verify your information).

You are not required to provide us the personal data that we request and can, in certain circumstances, stop us from collecting it by submitting a request. However, if you choose not to provide us the requested personal data, we may not be able to provide you with our services or with a high quality of service, or respond to your communication.

3. Marketing

We don't sell or rent your personal data to third parties for their marketing purposes without your explicit consent. We may process your personal data to improve and personalize our services, content and advertising. We use those data because LUXHABITAT has a legitimate interest to promote its products and services. If you don't wish to receive marketing communications from us, simply indicate your preference once you become a member of LUXHABITAT (or similar account status page) or by following the directions provided in an email or from a link on an advertisement. Even if you unsubscribe from some email subscriptions, we may still need to email you with important transactional or other non-advertising information. If you choose to personalise your experience with LUXHABITAT through a third-party login like Google or Facebook, we will automatically activate your account and subscribe you to our certain transactional email procedures. Should you wish to not receive these communications, you can unsubscribe through any email at any time. 4. Purpose

Our primary purpose in collecting and processing personal data is to provide you with a safe, smooth, efficient, and customized experience. Therefore, your personal data are collected and processed by us for the following purposes:

• to prevent potentially prohibited or illegal activities, and enforce our User Agreement;

• marketing, service updates, and promotional offers based on your communication preferences; 

• to compare information for accuracy, and verify it with third parties.

6. Activity Associated With User Ids

All of your activity on our Site is traceable to your User ID. LUXHABITAT reserves the right to send notices to 3rd parties regarding suspicious activity and policy violations on our Site and refer to User IDs and specific items.

7. Using Information From Luxhabitat

LUXHABITAT enables you to share personal information to complete transactions. We encourage you to disclose your privacy practices and respect the privacy of other users. We cannot guarantee the privacy or security of your information and therefore we encourage you to evaluate the privacy and security policies of your trading partner before entering into a transaction and choosing to share your information. To help protect your privacy, we allow only limited access to other users' contact information to facilitate your transactions. When users are involved in a transaction, they may have access to each other's name, User ID, email address and other contact information. In all cases, you must give other users a chance to remove themselves from your database and a chance to review what information you have collected about them.

You agree to use user information only for:

• LUXHABITAT transaction-related purposes that are not unsolicited commercial messages;

• Using services offered through LUXHABITAT (e.g. escrow, insurance and fraud complaints), or

• Other purposes that a user explicitly has agreed on chooses.

8. Cookies

We use "cookies" (small files placed on your hard drive) on certain of our pages to help analyze our web page flow; customize our services, content and advertising; measure promotional effectiveness, and promote trust and safety.

Most internet browsers are automatically set up to accept cookies. However, you can block cookies by activating the setting on your browser that allows you to refuse the setting of all or some cookies. 9. No Spam, Spyware Or Spoofing

We and our users do not tolerate spam. Make sure to set your LUXHABITAT notification preferences so we communicate to you as you prefer. You are not licensed to add other LUXHABITAT users, even a user who has inquired about a listing from you, to your mailing list (email or physical mail) without their express consent. To report LUXHABITAT-related spam or spoof emails to LUXHABITAT, please contact us. You may not use our communication tools to send spam or otherwise send content that would violate our User Agreement. We automatically scan and may manually filter messages to check for spam, viruses, phishing attacks and other malicious activity or illegal or prohibited content, but we do not permanently store messages sent through these tools.

10. Account Protection

Your password is the key to your account. Use unique numbers, letters and special characters, and do not disclose your LUXHABITAT password to anyone. If you do share your password or your personal data with others, remember that you are responsible for all actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your personal data and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately notify LUXHABITAT and change your password.

11. Your Rights About The Use Of Your Personal Data

You have certain rights listed below over how the data is processed and can exercise these rights at any point.

• The right to be informed. You have the right to be informed about the processing of your personal data in clear, easily accessible and easy to understand manner. This Privacy Policy is provided to you in connection with such right.

• The right to access, rectify and update. You have the right to access, rectify and update your personal data at any time by signing on to LUXHABITAT. Generally, we will not manually modify your personal data because it is very difficult to verify your identity remotely. If you wish to rectify or update personal data disclosed in a public posting, please let us know and we will take reasonable steps to respond to your request in accordance with legal requirements.

• The right to data portability. Under certain circumstances, you have the right to (i) request that we send you a copy of your personal data you provided to us, in which case we shall provide you with those data in a structured, commonly used and machine-readable format and/or (ii) transmit those data to another controller.

• The right to be forgotten. You have right to request that we erase your data. If you wish to erase the personal data we hold about you, please let us know and we will take reasonable steps to respond to your request in accordance with legal requirements. If the personal data we collect is no longer needed for any purposes and we are not required by law to retain it, we will do what we can to erase it.

Under certain circumstances, you have the right to restrict the processing of your personal data, for example, where the accuracy of the personal data is contested by you or if the personal data we collect is no longer needed for processing, but is required by you in connection with any legal claims.

• Rights related to automated decision-making. You have the right not to be subject to a decision which is based solely on automated processing and which produces legal or other significant effects on you. In particular, you have the right: 

o to obtain human intervention;

o to express your point of view;

o to obtain an explanation of the decision reached after an assessment; and\

o to challenge such a decision.

Upon your request, we will close your account and remove your personal data from view as soon as reasonably possible, based on your account activity and in accordance with applicable law. We may retain personal data from closed accounts to comply with law, prevent fraud, collect any fees owed, resolve disputes, assist with any investigations and take other actions otherwise permitted by law.

12. Security

Your personal data is stored on our servers. We treat personal data as an asset that must be protected and make extensive use of tools (encryption, passwords, physical security, etc.) to protect your personal data against unauthorized access and disclosure. However, as you probably know, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal data that they collect from the Site. Therefore, although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal data or private communications will always remain private.

13. Third Parties

Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of personal data we collect from you. If you disclose your personal data to others, whether they are buyers or sellers on our Site or other sites throughout the internet, different rules may apply to their use or disclosure of the personal data you disclose to them. LUXHABITAT does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. We encourage you to ask questions before you disclose your personal data to others.

14. Countries To Which We Transfer Your Information

The information that we collect from you may be transferred to and stored and hosted outside of the country from which you may be accessing the platforms, and may be transferred to countries which do not have data protection laws or to countries where your privacy and other fundamental rights will not be protected as extensively. For example, your personal information may be processed by staff operating outside such country, who work for us or for one of our suppliers. These and all other transmissions will remain secure and under our control. We will implement appropriate measures to ensure that your personal information remains protected and secure when it is transferred outside your home country and you can exercise your rights effectively.

15. Gdpr Compliance

Following the new EU General Data Protection Regulation (GDPR) that takes effect on May 25, 2018. We may need to collect and process personal information in order to provide the services to you or because we are legally required to do so. If you do not provide the information that we request, we may not be able to provide you with the services. We may use the personal information for our legitimate business interests, including those listed above.

We do not knowingly permit children in the EEA under age 16 to register for any content, product or service. We do not knowingly collect, use or disclose personal information about users under age 16, except as permitted by law.

We keep your personal information for as long as needed or permitted in light of the purpose for which it was obtained. The criteria used to determine our retention periods include (i) for as long as we have an ongoing relationship with you and provide the Services to you; (ii) as required by a legal obligation to which we are subject; or (iii) as advisable in light of our legal position (such as in regard of applicable statutes of limitations, litigation, or regulatory investigations).
